505 _aI. The prohibition of torture and right to health: an overview -- II. Abusive practices in health care settings and international human rights law: reflections
520 _a"Section I of this volume provides a broad overview of the problem of torture and ill-treatment in Health care setting worldwide. The unique context of detention in health care settings is explored, and the interplay between the right to health framework in international human rights law and the prohibition against torture and ill-treatment are addressed. The types of violations broadly identified as occurring in health care settings are those involving forced or coerced medical interventions, the denial of care, the provision of care in a humiliating manner, or the provision of inferior care on a discriminatory basis. Section II addresses the unique challenges posed by the abusive treatment of persons with psychosocial mental disabilities, with a particular view to questions of legal capacity and informed consent for psychiatric treatment and interventions. This section also examines the impact of the UN Convention on the Rights of Persons with Disabilities (CRPD), its emerging role in international human rights and disability law, and its interaction with the UN Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (CAT)
